These Terms of Service (the "Terms") govern your use of SavingSpoons.com and any associated websites, social media accounts, newsletters, and other digital properties (collectively, the “Site”) and your contractual relationship with Saving Spoons, LLC ("we," "us," "our"). By using, registering for, or purchasing anything from us or accessing the Site in any way, you agree to be bound by these Terms and our Privacy Policy, available on the Site and incorporated by reference. If you do not agree to these Terms, you may not access or use the Site.

1. Use of the Site

(a) You represent that you are at least 18 years of age and that all information provided is complete, accurate, and truthful.
(b) You agree not to use the Site for any unlawful purpose, including but not limited to:

• Violating any laws or regulations.
• Infringing upon intellectual property rights.
• Harassing or discriminating against any person or entity.

4. Product Purchases

(a) By placing an order on the Site, you agree to provide accurate billing and shipping information.
(b) Products on the Site may have limited availability, and descriptions are subject to change. Colors and sizes may vary slightly from those depicted in product images.
(c) All prices are subject to change at any time without notice.
(d) We reserve the right to refuse or limit any orders, including those that appear to be made by resellers or distributors.

5. Shipping and Delivery

(a) Shipping times are estimates, and we cannot be held responsible for delays caused by external factors, such as customs, weather, or carrier delays.
(b) Once an item is shipped, the risk of loss passes to you. Please check your local laws regarding import taxes or fees, as we are not responsible for additional charges upon delivery.

6. Returns and Exchanges

(a) We accept exchanges of non-customized items within 30 days of receipt. Items must be unused, in original condition, and accompanied by a receipt or proof of purchase. Customized products are not eligible for return.
(b) Shipping costs for returns are the customer’s responsibility.
(c) Refunds will be processed to the original method of payment within 7-10 business days after we receive the returned item. Shipping fees are non-refundable.

7. Custom Products

(a) Customized products are made to order and cannot be returned or exchanged unless there is a defect in workmanship.
(b) By submitting custom designs or text, you warrant that you own or have the right to use such designs and that they do not infringe on any intellectual property rights or break any laws.

8. Limitation of Liability

(a) Saving Spoons, LLC and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or any product purchased from us.
(b) Our total liability to you for any claim will not exceed the amount you paid for the product(s) in question.

9. Indemnification

You agree to indemnify and hold Saving Spoons, LLC harmless from any claims, damages, losses, or expenses (including attorney fees) arising out of your use of the Site or violation of these Terms.

10. Governing Law and Dispute Resolution

(a) These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law provisions.
(b) Any disputes arising from or relating to these Terms or your use of the Site shall be resolved through binding arbitration in Sheridan, in accordance with the rules of the American Arbitration Association.

11. Modifications to the Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page and will be effective immediately upon posting. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
